NARA HIRE COLLECTIVE — TERMS + CONDITIONS

These Terms & Conditions apply to all hire bookings made with Nara Hire Collective, including bookings made through our website or any other booking method approved by Nara Hire Collective.

By completing payment for a booking, the customer confirms that they have had the opportunity to read and agree to these Terms & Conditions together with the Returns, Refunds + Cancellations Policy, Shipping + Returns Policy and any other policies linked during the booking process.

1. Bookings

A booking is confirmed once the required payment has been successfully received and any required identity verification has been completed.

Nara Hire Collective may require valid photo identification or secure identity verification before confirming or fulfilling a booking.

The hired garment is provided to the customer named on the booking and must not be transferred, lent, sub-hired or provided to another person to wear without prior approval from Nara Hire Collective.

Customers are responsible for ensuring all booking information, including their name, address, contact details, selected garment, size, hire dates and delivery information, is correct.

2. Hire Period

The hire period is the period displayed and accepted when the booking is completed.

Standard hire periods may vary depending on the garment and booking option selected.

The customer must return the garment by the return date and time specified in their booking.

Any extension to the hire period must be approved by Nara Hire Collective in writing before the original return deadline.

Keeping a garment beyond the agreed hire period without approval may result in late fees and other reasonable costs where another confirmed booking is affected.

3. Hire Price + Security Bond

The hire price will be displayed before the booking is confirmed.

A refundable security bond may also apply and will be shown separately during the booking process.

The security bond is held as security against reasonable amounts that may become payable in connection with the hire, including:

  • late-return fees;
  • additional specialist cleaning;
  • repair costs;
  • damage;
  • loss; or
  • replacement costs.

The security bond is not an automatic damage charge.

Where no amount is owing, the security bond will generally be refunded within 1–3 business days after Nara Hire Collective has received and inspected the garment.

Where specialist cleaning, repair or assessment is required, Nara Hire Collective may reasonably retain the relevant amount until the issue and associated cost can be determined.

Where an amount payable exceeds the security bond, the customer remains responsible for the reasonable outstanding balance.

4. Ownership

All garments and accessories hired through Nara Hire Collective remain the property of Nara Hire Collective at all times.

Hiring a garment does not transfer any ownership interest to the customer.

5. Local Collection

Where local collection is selected, collection is available from Sunbury, Victoria, unless otherwise advised.

Collection details and instructions will be provided once the booking is ready.

For security and privacy purposes, Nara Hire Collective may provide exact collection instructions directly to the customer rather than publishing them publicly.

The customer is responsible for collecting the garment within the arranged collection window.

6. Postal Hires

Postal orders are generally sent using Australia Post Express Post unless another delivery method has been agreed.

Customers must provide accurate delivery information when booking.

Nara Hire Collective will make reasonable efforts to dispatch postal bookings in sufficient time for the selected hire period.

Delivery estimates provided by Australia Post are estimates and may be affected by circumstances outside the reasonable control of Nara Hire Collective.

Customers should monitor their tracking information and contact Nara Hire Collective as soon as possible if an issue arises.

Nothing in this section limits any rights available under Australian Consumer Law.

7. Returning Your Garment

Garments must be returned by the return deadline specified in the booking.

Unless otherwise agreed, garments should generally be returned on the next business day following the event or hire period.

The customer remains responsible for the garment until it has been:

  • physically received by Nara Hire Collective; or
  • correctly packaged and accepted over the counter by Australia Post for an approved postal return.

8. Postal Returns

Postal returns must be sent using Australia Post Express Post unless another return method has been approved.

Returns must generally be lodged over the Australia Post counter by 4:00 PM on the next business day following the event.

Customers must:

  • obtain a tracking number;
  • retain their lodgement receipt;
  • provide tracking details to Nara Hire Collective if requested; and
  • avoid placing the return parcel in a street posting box.

Where a return has been correctly packaged and lodged on time, delays occurring within the Australia Post network will not themselves be treated as a late return.

If the required return day falls on a public holiday and Australia Post outlets are unavailable, the next available business day will apply unless another arrangement has been made.

9. Late Returns

Late returns may incur a fee of $25 per day.

If a late return directly causes another confirmed customer's booking to be cancelled or materially affected, the customer may also be responsible for Nara Hire Collective's reasonable direct loss resulting from the delay, to the extent permitted by law.

Customers should contact Nara Hire Collective immediately if they believe they will be unable to return a garment on time.

Repeated or significantly late returns may result in Nara Hire Collective declining future bookings.

10. Garment Care

Customers must take reasonable care of all garments throughout the hire period.

Customers must not:

  • cut or alter the garment;
  • permanently hem or tailor the garment;
  • remove labels or embellishments;
  • use fabric glue or other permanent adhesives;
  • wash or soak the garment;
  • dry-clean the garment themselves;
  • aggressively spot-clean stains; or
  • carry out repairs without approval from Nara Hire Collective.

Reasonable care should be taken around:

  • fake tan;
  • makeup;
  • perfume;
  • body oils;
  • hair products;
  • food and drinks;
  • smoke;
  • candles;
  • pets;
  • sharp objects;
  • mud and grass; and
  • rough or abrasive surfaces.

For long garments, customers should lift the hem where reasonably possible when walking over wet, dirty or abrasive surfaces.

If a significant spill, stain or damage occurs, contact Nara Hire Collective as soon as possible rather than attempting to treat it yourself.

11. Cleaning

Standard professional cleaning following ordinary wear is included in the hire price.

Customers are not required to clean the garment before returning it.

Where excessive staining, contamination or damage requires specialist treatment beyond normal professional cleaning, the customer may be responsible for the reasonable additional cleaning cost.

Nara Hire Collective will, where reasonably available, provide an explanation or supporting evidence of additional cleaning costs charged to the customer.

12. Condition of Garments

Garments supplied by Nara Hire Collective form part of a working rental collection and may have been worn previously.

Minor signs of normal use may be present, including:

  • small professional repairs;
  • minor pulls;
  • loose threads; or
  • subtle fabric wear.

Minor signs of reasonable previous use do not automatically constitute a fault or entitle the customer to a refund.

Customers should inspect their garment when it is received or collected.

Any unexpected existing marks, damage or concerns should be photographed and reported to Nara Hire Collective before the garment is worn.

13. Damage

Customers may be responsible for damage occurring while a garment is in their possession where that damage goes beyond reasonable wear from normal use.

Depending on the circumstances, reasonable costs may include:

  • repairs;
  • specialist cleaning;
  • restoration; or
  • reasonable loss in value caused by the damage.

Nara Hire Collective will generally attempt repair or restoration where this is commercially reasonable before treating a garment as beyond repair.

Where a garment is damaged to the extent that it cannot reasonably be repaired or can no longer remain in the Nara Hire Collective rental collection, the customer may be responsible for Nara Hire Collective's reasonable loss up to the replacement value disclosed for the garment.

The appropriate amount will depend on factors including the garment's age, condition, repairability, availability and reasonable replacement cost.

Any applicable amount may be deducted from the security bond.

If the amount exceeds the bond, the customer remains responsible for the reasonable outstanding balance.

14. Lost, Stolen or Unreturned Garments

The customer is responsible for the garment from the time it is collected or received until it has been properly returned.

If a garment is lost, stolen or cannot be returned, the customer must notify Nara Hire Collective immediately.

Where a garment cannot reasonably be recovered, the customer may be responsible for Nara Hire Collective's reasonable loss up to the garment's stated replacement value.

Where theft is reported, Nara Hire Collective may reasonably request supporting information such as a police event or report number.

The security bond may be applied toward an amount properly payable under this section.

15. Fit + Sizing

Sizing information and garment measurements are provided as guidance.

Sizing can vary substantially between designers, garments and individual body shapes.

It is the customer's responsibility to select the garment and size they wish to hire.

Where the correct garment and size have been provided as booked, Nara Hire Collective does not provide a refund solely because:

  • the customer changes their mind;
  • the customer does not like the fit;
  • the customer does not like the style on themselves; or
  • their personal circumstances or event plans change.

This does not limit any rights available under Australian Consumer Law.

Customers who are unsure about sizing are encouraged to book a Nara Hire Collective try-on appointment before hiring.

16. Cancellations + Refunds

The following policy applies to customer-initiated change-of-mind cancellations where there is no fault with the garment or service supplied by Nara Hire Collective.

More than 14 days before the hire date

A full refund of the hire fee will be provided.

7–14 days before the hire date

The customer will receive 75% of the hire fee as Nara Hire Collective store credit.

Store credit will be valid for 6 months from the date it is issued.

Less than 7 days before the hire date

The hire fee is non-refundable and non-creditable.

Within 48 hours / no-show / failure to collect

The full hire fee will be forfeited.

Once the garment has been collected, delivered or dispatched, a change-of-mind cancellation is no longer eligible for a refund or store credit.

Security bond

Where a booking is cancelled before the garment has been collected, delivered or dispatched, any refundable security bond paid will be refunded in full.

These cancellation rules do not limit any rights available under Australian Consumer Law.

17. Try-On Appointments

Try-on appointments are available by prior booking and are generally 30 minutes.

A $10 try-on fee applies to each appointment.

The $10 try-on fee is redeemable toward a Nara Hire Collective hire booking made within 24 hours of the try-on appointment.

Unless otherwise stated, try-on appointments are held in Sunbury, Victoria.

Customers must take reasonable care of all garments during their appointment and may be responsible for damage they cause.

Please avoid attending a try-on appointment with:

  • wet fake tan;
  • excessive body oils; or
  • anything else reasonably likely to transfer onto or damage the garments.

If an appointment is cancelled within 24 hours of the scheduled appointment, the $10 fee is non-refundable.

Customers who arrive more than 15 minutes late may have their appointment cancelled and the try-on fee will not be refunded.

A maximum of one guest may accompany the customer unless Nara Hire Collective has approved another arrangement.

The try-on fee applies to the appointment and does not guarantee that a particular garment will remain available for a future event date unless a hire booking is subsequently confirmed.

18. Photo Identification + Identity Verification

Nara Hire Collective may require photo identification or another reasonable identity-verification process as a condition of hire.

A booking may not be confirmed or fulfilled until any required verification has been successfully completed.

Identity information will only be requested where reasonably necessary for purposes including:

  • booking verification;
  • fraud prevention;
  • security; or
  • protecting the Nara Hire Collective rental collection.

Personal information will be handled in accordance with the Nara Hire Collective Privacy Policy and applicable privacy laws.

19. Photography + Social Media

Nara Hire Collective loves seeing customers in their hires.

Where a customer publicly tags or mentions Nara Hire Collective in photographs or videos, Nara Hire Collective may contact the customer to request permission to repost that content through Nara Hire Collective's social media or marketing channels.

Tagging Nara Hire Collective does not automatically transfer ownership of a customer's content to Nara Hire Collective.

20. If Nara Hire Collective Cannot Fulfil a Booking

Occasionally a garment may become unavailable due to unexpected circumstances such as:

  • damage during a previous hire;
  • loss;
  • a significantly delayed return; or
  • another circumstance preventing the garment from being supplied.

If Nara Hire Collective cannot supply the confirmed garment, Nara Hire Collective will contact the customer as soon as reasonably possible.

Where appropriate, the customer may be offered:

  • a suitable alternative garment;
  • rescheduling;
  • store credit; or
  • a full refund.

Where Nara Hire Collective cannot provide the booked garment and the customer does not accept an alternative, amounts paid for the unavailable hire will be refunded.

21. Events Outside Reasonable Control

Nara Hire Collective will not be treated as responsible for a delay caused solely by circumstances outside its reasonable control to the extent permitted by law.

Where an unexpected event materially affects a booking, Nara Hire Collective and the customer should communicate as soon as reasonably possible so an appropriate solution can be considered.

22. Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

23. Acceptance of Terms

By completing payment for a booking, the customer confirms that they have had the opportunity to read and agree to:

  • these Terms & Conditions;
  • the Nara Hire Collective Returns, Refunds + Cancellations Policy;
  • the Nara Hire Collective Shipping + Returns Policy; and
  • any other policies clearly provided or linked as part of the booking process.

The version of these Terms & Conditions made available when the booking is confirmed will apply to that booking.

Nara Hire Collective may update these Terms & Conditions for future bookings. Any later changes will not retrospectively alter the terms applying to an already confirmed booking.
